Acceptance of Terms

• By posting a classified on this platform, you agree to comply with and be bound by the following Terms and Conditions. These terms are designed to ensure a professional, ethical, and compliant use of the Classifieds feature on this website.

Eligibility to Post

• Only registered Business Rescue Practitioners (BRPs) with verified profiles on this website are permitted to post classifieds.
• By posting a classified, you affirm that you are the appointed BRP in the matter related to the content of your post.
• Classifieds must pertain exclusively to business rescue projects as defined under the Companies Act 71 of 2008.

Authorization and Responsibility

• By submitting a classified, you confirm that you are authorized to post the content on behalf of the entity or project it pertains to.
• You accept full responsibility for the accuracy, legality, and appropriateness of the information provided in your classified.
• You must not post any classified that misrepresents your role, misleads users, or violates the rights of third parties.

Permissible Content

Classifieds must relate directly to business rescue activities, including but not limited to:

• Securing post-commencement finance (PCF)
• Seeking investment partnerships
• Selling distressed assets
• Offering assistance or services related to business rescue matters

Posts unrelated to business rescue, such as personal advertisements, general commercial opportunities, or unrelated financial solicitations, are strictly prohibited.

Prohibited Content

• You agree not to post any classifieds that:
• Contain false, misleading, or fraudulent information.
• Include content that is offensive, defamatory, or violates any laws or regulations.
• Advertise services or products unrelated to business rescue.
• Solicit unlawful activities or create unauthorized partnerships.

Compliance with Laws

• All classifieds must comply with applicable South African laws, including but not limited to the Companies Act 71 of 2008 and related regulations governing business rescue.
• You agree to ensure that your post does not infringe upon the intellectual property or proprietary rights of others.
• Practitioners must ensure compliance with the Protection of Personal Information Act (POPIA) when posting classifieds. Any information provided must not contravene POPIA, and practitioners must ensure that any personal or sensitive information shared has the proper consent of the data subject. Misuse or unauthorized disclosure of personal information will not be tolerated and may result in immediate removal of the classified and/or suspension from the platform.

Review and Approval

• All classifieds are subject to review and approval by the website administrators.
• The administrators reserve the right to reject, modify, or remove any classified that violates these Terms and Conditions without prior notice.

Indemnity

• You agree to indemnify and hold the website, its owners, and administrators harmless from any claims, damages, or liabilities arising from the content of your classified or your use of this platform.

Limitation of Liability

• The website does not guarantee the success of any classified post or the availability of opportunities through this platform. Users are solely responsible for the outcomes of their engagements.
